Explanation:

 

SECOND READING:

Following the first reading on September 4, 2024, City Commission directed staff to remove the prohibition on adult uses, proposed during first reading. The proposed ordinance for second reading retains the prohibition on smoke shops but eliminates the prohibition on adult uses.


Staff has also included the C-1 Low Intensity Commercial District within the Ordinance, which was erroneously omitted in first reading.

 

In accordance with the Article 11 of the City’s Code of Ordinance,  the operation or expansion of adult entertainment establishments is limited. No individual or entity shall propose, initiate, or permit the operation or expansion of an adult entertainment establishment, except where such expansion is legally mandated. These establishments are only permitted within the following zoning districts: C-1, C-2, C-3, C-4, C-5, IM-1, IM-2, IM-3, IM-4, and PEDD. While the there is a C-1 Zone located on east of the Intracostal, required distance separations, inlcuding from residential zones would automatically prohibit the establishment of an adult use.

 

Also, considered Adult Uses are body piercing, tanning and tattoo establishments, which are only permitted within IM-1 zoning districts and also require distance separations.

 

FIRST READING:

The request to amend the permitted use list in Beach commercial zoning districts to prohibit smoke shops and adult uses is grounded in key planning principles that aim to enhance the quality of life, ensure the safety of residents and visitors, and foster a vibrant, family-friendly commercial environment. This proposed amendment follows Ordinance O-2023-16, adopted on December 6, 2023, which sought to limit the proliferation of smoke-shops in commercial areas Citywide. This particular focus on the Beach commercial zoning districts and areas east of the Intracoastal Waterway further refines the approach of maintaining a desirable and health-conscious community atmosphere.

 

Hollywood Beach, one of the City’s most economically significant areas, boasts a unique character that appeals to both residents and tourists seeking recreational, family-friendly experiences. Prohibiting smoke shops and adult uses aligns with the goal of preserving the area’s welcoming and inclusive nature. The presence of such businesses could detract from the family-oriented and recreational focus essential to the success of the beach districts. Maintaining the attractiveness and accessibility of these areas for all demographics is vital for sustaining their appeal and economic vitality.

 

On May 14, 2023, the Planning and Development Board acting as the Local Planning Authority heard the item and recommends that the item be brought forward to City Commission for review and adoption.
