Explanation:

On March 12, 2019, the City held a Special Election wherein a majority of voters approved funding in the amount of $14,091,065.00, through a General Obligation Bond (“GO Bond”), for the Tidal Flooding Mitigation and Shoreline Protection Project (“Project”). The Project’s purpose was to provide tidal barriers to the City-owned properties most vulnerable to tidal flooding, around the two man-made inlets known as North Lake and South Lake. 

 

The Project was divided into 22 smaller projects, matching the parcel map, and classified by phases. Eight locations were classified as Phase 1 projects and were slated for completion under the GO Bond project scope.

 

The City secured a design consultant for the project, approved under R-2020-275. The contract stipulated that the design for Phase 1 projects be developed from survey, planning, permitting, final design and construction engineering services. Fourteen projects were classified as either Phase 2 or Phase 3 projects.  The scope of services included only the development of conceptual design for Phases 2 and 3. These conceptual drawings were utilized to apply for grant funding.

 

The Department of Design and Construction Management (“DCM”), on behalf of the City, submitted a grant application to the State of Florida Department of Environmental Protection (“FDEP”) for funding through its Resilient Florida Grant Program, in the amount of $13,908,935.00, to assist in funding the design and construction of the Phase 2 and 3 projects.

 

FDEP awarded the City a total of $14,112,000.00 to fund the design and construction of the remaining Phase 2 and 3 projects. On September 21, 2022, the City Commission passed and adopted Resolution No. R-2022-281, authorizing the appropriate City officials to accept and execute FDEP Resilient Florida Grant (“Agreement No. 22FRP13”) and authorizing the required matching funds to be paid from the GO Bond.

 

FDEP requested updates to Agreement No. 22FRP13’s exhibits and attachments (“Amendment 1”), and the revised Grant Work Plan providing for the City to fund all design and construction administration costs which will count as grant match.  The City is to fund construction costs not less than $12,204,935.00 and FDEP to fund construction costs up to $14,112,000.00.

 

FDEP also requested the Project be titled “Hollywood Tidal Flooding Mitigation and Shoreline Protection” going forward. This Amendment 1 was approved by the City Commission on December 6, 2023; also approving and authorizing the appropriate City Officials to execute all applicable grant documents, agreements and amendments.

 

FDEP Grant Amendment 2, with an award total of $18,323,301.45, requires construction using FDEP funds to be completed by June 30, 2026.

 

On March 5, 2025, the City Commission passed and adopted Resolution No. R-2025-072, awarding  Invitation for Bid IFB-267-25-WV for Hollywood Tidal Flooding Mitigation and Shoreline Protection Project Sites 3,4,5,11,12,7,8,14,15 & 16 FDEP 22FRP13  (“IFB-267-25-WV")  to Shoreline Foundation, Inc. in the amount up to $3,648,808.00. (Group A).

                                          

The remaining FDEP funds will be used to fund Sites 9,10,17 and 19, undergoing permitting as Group B, and Sites 2 and 22 (Group C) if needed.

 

It is in the best interest of the City to retain Construction Manager at Risk (“CMAR”) services for the Hollywood Tidal Flooding Mitigation and Shoreline Restoration project FDEP-22 FRP13-, approved as part of the GO Bond.

 

On January 9, 2025, the DCM and the Office of Procurement and Contract Compliance (“Procurement”) issued Request for Proposals RFP-274-25-WV (“RFP”) for the project, and the RFP was advertised on www.opengov.com <http://www.opengov.com>.

 

On February 14, 2025, one proposal package was received in response to the RFP from the following CMAR firm:

A Selection Committee comprised of in-house professionals, including the Chief Resiliency Officer, the Engineering Support Services Manager of DCM, the Assistant Parks Manager of Parks, Recreation and Cultural Arts, the Floodplain Development Review Coordinator of Utilities, were assigned the task of evaluating proposals and ranking the firms.

 

On March 11, 2025, members of the Selection Committee met in a publicly advertised meeting to review and evaluate the proposal and, after evaluation and discussion, unanimously agreed to rank The Whiting-Turner Contracting Company as highly qualified pursuant to the criteria in the RFP.

 

Notice of Intent to Award was posted on March 13, 2025 and no protests were received.

 

DCM and Procurement recommend that the City Commission approve the final rankings and authorize the appropriate City officials to negotiate the CMAR Services Phase I, Pre-Construction Agreement with The Whitting-Turner Contacting Company. Upon negotiating the Phase I Pre-Construction Services Agreement with the highest-ranked firm, if the agreement amount falls within the $135,000.00 approved and authorized by this Resolution, the City Manager will execute the agreement; however, if the agreement amount exceeds this approval authority, the agreement will be brought back to the City Commission for consideration.

 

After execution of the Phase I Pre-Construction Services Agreement, the parties will negotiate the Phase II Construction Services Agreement for consideration by the City Commission at a later date, as defined in the RFP Scope of Services. The City reserves the right to reduce the Project scope as needed, and award any portion of the Project as required to meet the intent of the Project, grant conditions, coordination with other work and/or funding availability.

 

Fiscal Impact:

Funding for this project was included in the amended FY 2025 Capital Improvement Plan and is available in account numbers 334.179901.51900.531213.001360.000.000 and 333.149901.54100.563010.001187.000.000.
