Explanation:

Petitioner, Dwayne L. Dickerson, Esq., of Miskel Backman, LLP, acting on behalf of the owner (Kimco Realty Corporation) and the Applicant (Taco Bell of America, LLC), of 2700 Stirling Road is requesting a plat amendment to modify the existing Non-Vehicular Access Line (“NVAL”) along the west parcel boundary of Lot 1-B within the “Hollywood Commercial Center” Plat, attached as Exhibit “A”. This plat/property is located on the north side of Oakwood Plaza.

 

The Property is +/-0.67 acres (folio number 5142-04-11-0020), and currently has an existing +/-2,800 square foot Taco Bell restaurant on the site. The Applicant has initiated the development review process and is proposing to demolish the existing building and construct a new +/-2,200 square foot Taco Bell Restaurant. As part of this process the applicant is required to reevaluate vehicular access points for safety. During this review, it was determined changes were necessary.

 

The site currently has a +/-16’ egress only driveway opening located 28’ from Stirling Road, which is within the existing NVAL that runs along Lot 1-B and terminates 55’ from Stirling Road.

 

With the proposed new construction, the Applicant would like to modify the NVAL to allow for a 30’ egress right-turn only driveway opening approximately 30’ from Stirling Road.

 

Broward County has preliminarily reviewed the modification and is also requiring the NAVL to extent 50’ beyond the proposed driveway opening which means it will terminate approximately 85’ from Stirling Road.

City Commission approval is necessary prior to the application for the Broward County Commission to consider the plat amendment.

 

Staff has reviewed the request and finds the proposed development remains consistent with the concurrency standards established for the Plat, and therefore recommends approval.

 

 

Fiscal Impact:

Approval of this resolution will not fiscally impact the City.
